MODEL VEHICLE STATUS
Dear customer,
thank you for choosing our services, we wish to inform you on the procedures adopted by us to charge for any damage caused to the motorcycle during the rental period and penalties for infringements of the highway code. Having received all the necessary information in this regard, we ask you to confirm receipt and actual understanding and sharing by signing the following declaration.
DECLARATION
ROAD CODE INFRINGEMENT
If during the rental period I have been raised with administrative sanctions for infringements of the Stra da Code, the “RENT FOR OLBIA” will provide my data to the Municipality or Authority that challenged me the violation and imposed the sanction, in order to make possible the re-notification of the sanction against me, charging my credit card the amount of € 50.00 plus VAT as a reimbursement for the costs of handling the file (for each case). If I am aware of a penalty for infringement of the Highway Code that I have raised, I will pay it, in order to avoid the above charge.
DAMAGES CAUSED BY VEGETATION < br> I acknowledge that I am responsible for any damage caused by vegetation. Such damage is attributable to my negligence in driving the motorcycle on country roads or in places where vegetation can cause scratches or damage to the vehicle.
IT IS ABSOLUTELY FORBIDDEN TO DRIVE ON NON-ASPHALT ROADS
I acknowledge that the undersigned is fully responsible for any damage caused as a result of driving on unpaved roads.
LOCALIZATION
I expressly authorize, and without any reservation, the Lessor, or otherwise. subject by the same person in charge, to remotely monitor the correct use and operation of the rented motorcycle through satellite alarm systems or similar, as well as to control any alarms or movements of the motorcycle outside the area permitted by the contract.
RETURN OF VEHICLES DURING OFFICE OPENING HOURS
I acknowledge that vehicles must be returned during office opening hours. If I return the vehicle while the local office is closed, I will be held responsible for all damage to the vehicle that may be caused during the parking period until the office opens, when the “RENT FOR OLBIA” staff will take over the vehicle.
JURISDICTION
For any dispute arising from this contract, the parties agree that the Court of Olbia will be competent. The above provision does not apply, however, to Customers who demonstrate that they are qualified as consumers pursuant to art. 3, co. 1 letter a), of the Legislative Decree 6 September 2005, n. 206 (so-called Consumer Code); in which case, the court of the Customer’s place of residence or domicile of choice will be competent. the rental contract is governed by Italian law and law, therefore, for any dispute relating to it, only Italian law and law are applied before any court and authority.
